1. Introduction
1.1 Free Gift Promotion ("Campaign") is organized by AutoCraze Pyt Ltd. The terms and conditions and the Privacy Policy posted on this site will be construed as the terms and conditions ("Terms and Conditions") of this Campaign on which AutoCraze offers you ("Customer") access to and use of this site for the purposes of this Campaign.
1.2 This campaign is an Online only initiative. Only available for customers that are purchasing items online.
1.3 Customers agree to comply with all the above when accessing or using this site. The scope of this Terms and Conditions is limited to AutoCraze’s role of hosting this site and organising this Campaign only.
1.4 Details of the promotion are as per below:
a) With every purchase of wheels & tyre package or car accessories from the website (https://www.autocraze.com.au/) above AUD 1499 Customer will be entitled to one (1) unit of Kogan Dash Cam. Free gift will be delivered to Customer within 30 days of purchase by the Customer. In case the product is out of stock customer will be entitled to receive a similar item of the same value.
b) With every purchase from the website (https://www.autocraze.com.au/) above AUD 2499 Customer will be entitled to one (1) unit of the Kogan Dash Cam and the OBD Car display as a package. Free gift will be delivered to Customer within 30 days from date of purchase by the Customer. In case the product is out of stock customer will be entitled to receive a similar item of the same value.
c) One order will be entitled to receive only one gift.
d) If the order is a pre-order and the user cancels after the gift has been dispatched by AutoCraze - the retail price of the free gift will be deducted from the refunded amount.
1.5 The sale transaction in this Campaign is only between the AutoCraze website (www.autocraze.com.au) and the Customer. AutoCraze only provides the and redemption guidance on this website.
1.6 AutoCraze only acts as the coordinating party and is not involved or a party of any monetary/sale and purchase of this campaign transaction..
2. Campaign Mechanics
2.1 The following are three (3) steps for the Promotion:-
Step 1: Purchase the products from the website https://www.autocraze.com.au/)
Customer to make a purchase from the website.
Step 2: Order value in accordance with the conditions mentioned above under section 1.3.
Step 3: Delivery of Free Gift
Once complete, Free Gift will be delivered to the Customer’s address within 30 days from date of redemption submission by Customer.
3. Duration
3.1 This Campaign will begin from 3:00pm, 1st July 2021 (Thursday, Sydney time) to 10:00pm, 2nd August 2021 (Monday, Sydney time) (“Campaign Period”).
3.2 AutoCraze reserves the right to cancel, shorten, or extend the Campaign Period without prior notice.
3.3 AutoCraze reserves the right to approve or decline any order placed by the customer.
4. Eligibility
4.1 The Promotion is open to all residents of Australia including Australians and non-Australians who reside in Australia.
4.2 One Customer is entitled to one (1) Free Gift only.
5. Customer's Covenants
5.1 In connection to this Campaign, Customer will not use this site:
a) To submit fraudulent order, false, inaccurate, misleading, defamatory, or libelous information;
b) To distribute viruses or any other technologies that may harm AutoCraze, or the interests or property of other users;
c) To export the unit purchased except in compliance with the export control laws of relevant jurisdictions and in accordance with posted rules and restrictions;
d) In the event AutoCraze suspects or discovers that the Customer is abusing this Campaign and/or AutoCraze in any of the ways mentioned above or otherwise, AutoCraze may, at our sole discretion, take necessary steps to prevent and mitigate such abuse such as limiting, suspending, or terminating the Customer's user account(s) and access to this site, delaying or removing hosted content, removing any special status associated with Customer account(s), reducing or eliminating any discounts, and taking technical and/or legal steps to prevent Customer from using this site.
6. Limitation of Liability
6.1 AutoCraze uses its reasonable effort to keep its site safe, secure, and functioning properly, but AutoCraze does not guarantee the continuous operation of or access to this site.
6.2 Customer agrees that he/she is making use of this site at his/her own risk, and that it is being provided to Customer on an "AS IS" and "AS AVAILABLE" basis.
6.3 To the extent permitted by applicable law, AutoCraze excludes all express or implied warranties, terms and conditions including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
6.4 Customer shall assume full responsibility in case of any accident, damage or claim resulting from participating in this Campaign.
6.5 Customer shall be deemed to be able to perform legally binding contract upon his/her submission of personal details and there shall not be any refund or costs whatsoever arising from his/her violation of the stated herein.
7. Indemnity
7.1 Customer will fully indemnify and hold AutoCraze (and our affiliates and subsidiaries, and our and their respective officers, directors, employees, agents) harmless from any claim or demand, including reasonable legal fees, made by himself/herself or any third party due to or arising out of his/her breach of these Terms and Conditions, improper use of the site or breach of any law or the rights of a third party.
8. Privacy
8.1 By providing Customer's personal data, Customer is indicating that he/she has read, understood and agreed that his/her personal data will be recorded, stored or otherwise processed in accordance to AutoCraze’s Privacy Policy available at https://www.autocraze.com.au/privacy-policy/
9. General
9.1 In the event AutoCraze have queries with regard to the Campaign; please call AutoCraze helpline at 1800-099-634 for clarification.
9.2 AutoCraze reserves the right to make amendments to the Terms and Conditions of the Campaign herein without prior notice.
9.3 AutoCraze reserves the rights to change the Free Gift /promotion items with product(s) of similar value in the event of out of stocks.
9.4 All pictures and/or images of the Free Gift found in any advertising and marketing materials are for illustration purposes only and may be different from the actual products.
9.5 AutoCraze reserves the right to disqualify any submissions for the Free Gift redemption in the event of violation of any of the Terms and Conditions.
9.6 In the event of any discrepancies between the information that Customer has submitted with regards to the redemption of Free Gift and for any reasons whatsoever, AutoCraze shall not be responsible for any loss or costs arising from such discrepancies howsoever caused.
9.7 In case of any dispute, AutoCraze reserves the right to make the final decision and shall have the right to cancel, disqualify the order or forfeit the deposit necessarily.
9.8 By participating in this Campaign, Customer fully and unconditionally agrees to and accepts AutoCraze’s Privacy Policy as stated above, and the Terms and Conditions.
9.10 In the event of inconsistencies between the terms and conditions found elsewhere with regard to this Campaign (if any) and the Terms and Conditions herein, the latter shall prevail.
9.11 These Terms and Conditions herein shall be governed by the laws of Australia and the jurisdiction of the courts of Australia.
